NYCLU Investigating Fox Ban

This afternoon the New York Civil Liberties Union announced it was investigating Fox’s decision to ban our new ad.

The NYCLU believes that Fox’s decision is a clear case of censorship based on content, and very well may be in violation of Federal law.

More details will be posted as they become available, but please use the thread below to discuss this new development.

Isn't this clear content based illegal censorship if FOX banned it because of the Bush image? How is this a close call?

They didn't ban it because of the bush image. The just don't want a liberal ad on their sacred fair and balanced channel.

Fox or any other media outlet may ban an ad for content they deem inappropriate. The ad was produced for shock value. Personally I don't find it that shocking, however, I found the total disrespect for the office of the presidency in very poor taste. Regardless of our views on this particular president, that image was tasteless.

Reading all the rants accusing the ad of 'disrespecting the presidency' ii imagine I'm listening to all the sycophants of the 'emperor has no clothes' story ooohing and aaahing over the clothes that don't exist. The ad is perfectly right, Bush himself has brought disrespect into the Oval office with all of his lies and scapegoating. The office of the President deserves unique respect because of the responsibility the holder bears for the nation.
Since when has Bush taken any responsibility for the disasters of his administration?

Fox refusing to air your commercial is not a violation of your rights. It is their TV station and not yours. If the government forcibly prevented Fox from airing the commercial then it would be censorship. Free speech is not the right to someone else's podium.

Censorship is when someone silences you. Censorship is not a private company actually choosing not to broadcast your message on their equipment to their viewers.

Just a reminder...that private company uses public air waves with a license from the federal government.

Go get 'em, Brian. Katrina has exposed the emperor. Its almost fun watching Fox and the other cronies of the administration trip all over themselves trying to cover him back up. Whether you win or lose doesn't matter. Fox's desparate act has paid off in getting you more press than the spot would have.

I wish I was still a Manhattan resident so I could vote for you. If there were more guys like you running for office when I was I might still be there.

I just wanted to say that, although I'm in California and a moderate Republican, I support your candidacy. New York is an endearing place and I hope you can do as much there as you can to make it a shining example of what a major American city needs to be.

In Los Angeles, our new mayor isn't doing anything and I hope to run against him to show him how to effectively run a city. Although, you're not running for mayor, it's still a leadership position and I hope you shine with the best of them!
